That's a nice explanation you're offering, now put it into the terms of service what constitutes chronic, what constitutes eggregious, and at what point you decide to pull the trigger. Because if it isn't the in the terms of service, its hot air.
As for donating to charity, nice way to divert criticism, but I'd have a field day fining spammers and could care less where the fines went. Just because you're donating to charity (I have a few I'd like to fund myself, and get the tax writeoff for doing so), does not make the open ended and undefined liquidated damages any less excusable.
